TERMS & CONDITIONS
These terms and conditions apply to your use of the website nsw.ipaa.org.au and the pages hosted at that domain (including illuminate.nsw.ipaa.org.au and nsw.ipaa.org.au/insights) (collectively, the "Website"), and any graphics, code, text, software, audio, music, design, information, names, images, pictures, logos and icons used by the Website (the "Content").
These terms and conditions also apply to any purchases made through the Website, including for courses and events.
Please read these terms and conditions carefully before using the Website and/or making any purchases on the Website. By accessing or using the Website, you agree to be bound by these terms and conditions, the Privacy Statement and the Copyright Statement (the "Terms"). If you do not agree to the Terms, you must not use the Website or proceed with a purchase (if applicable).
Capitalised terms used in these Terms are defined in the 'Interpretation' section at the end of this document.

Registration and Confirmation
Registrations for courses and events are accepted via the Website, phone or email. Your place will be confirmed upon receipt of your registration. A confirmation and receipt will be sent within 24 hours.
Payment policy
Payment for your membership of IPAA NSW is due 14 days from the date of the invoice. We reserve the right to cancel your membership if you fail to pay membership fees within 60 days of the renewal date.
For all other purchases on the Website, payment must be made either in full online at the time of confirming the purchase or 14 days from the date of the invoice. For course and event purchases, if you do not pay in full at the time of reservation, then we may in our sole discretion cancel your reservation.
Payment is required prior to attending the event or course. Please contact an IPAA NSW staff member if an exception is required.
Payment amounts
Any prices or payments on the Website are in Australian dollars.
Unless otherwise specified, any consideration payable or to be provided for a supply made under or in connection with the Website does not include any amount on account of GST. If GST is payable, to any extent, on any supply made under or in connection with Website, the recipient of the supply must pay, to the supplier, an additional amount equal to the GST payable on the supply, and if requested, the supplier must give the recipient a tax invoice for the supply. If a payment to a party is a reimbursement or indemnification, calculated by reference to a loss, cost or expense incurred by that party, then the payment will be reduced by the amount of any input tax credit to which that party is entitled for that loss, cost or expense.
Words or expressions used in this section which are defined in the A New Tax System (Goods and Services Tax) Act 1999 (Cth) have the same meaning in this section.
Cancellation policy
• Cancellation must be in writing and confirmed by an IPAA NSW staff member
• Cancellation received more than 10 business days prior to start date – no penalty will be incurred
• Cancellation received withing 5-10 business days prior to start date – 50% of the fee is payable
• Cancellation received within 1-5 business days prior to the event running – 100% of the fee is payable
• No show – 100% of the fee is payable
Cancellation policy – Self-paced courses (online with 365 days access)
• Cancellations are not permitted
• Transfers to another course are not allowed for self-paced courses.
Transfer policy – Public courses
• All requests for transfers must be in writing
• Your course registration can be transferred to another course without penalty if requested more than 10 business days prior to the course start date. Otherwise, the above cancellation policy applies. Transfers can only be requested when the course fee has been paid in full.
• Transferring your registration to another person can be done at any time without penalty if nominee details are provided within a minimum of 2 business days prior to the course start date. Transferring from a member to a non-member will result in a fee increase in line with the non- member course fee. Please note that for any late transfers that include catering, we will be unable to accommodate dietary requirements.
Attendance Policy for Multi-Day Courses
Participants are required to attend all scheduled sessions of their registered course. Missed sessions are non-transferable and will be considered forfeited. If a participant fails to attend any scheduled session, they will be unable to progress in the course and must re-enrol and pay the full course fee.
Medical Requests: Any requests for waivers, credits, or transfers due to medical reasons must be submitted with supporting documentation (e.g., a medical certificate) within 5 business days of the missed session for consideration. Failure to provide the necessary documentation will result in adherence to the standard cancellation policies, and the cancellation fee will likely apply, even in cases involving medical documentation.
We may in our discretion waive cancellation charges in exceptional circumstances, but we will not waive cancellation charges on account of work commitments
Events

Substitute nominees may attend in your place where deemed by us in our discretion as appropriate however if a member wishes to substitute a non-member in their place, the full fee will be payable. Note that if a registrant does not cancel and does not attend, the total fee is still payable.
Group booking policy
To qualify for the group booking rate, three or more people from the same agency must book and pay together for the same course or activity. All participants must register for the same course, at the same time, and at the same rate to be eligible for the group discount.
Pre-requisites
By registering for a course, you agree that you meet the course pre-requisites and that you have read and understood the policies and procedures which can be downloaded from the course page.
Program changes
IPAA NSW reserves the right to change courses, programs and/or speakers, or to cancel courses or programs if enrolment criteria are not met or when conditions beyond its control prevail. All registrants will be notified in the event of cancellation, and their registration fee will be refunded.
Membership
IPAA NSW memberships are individual and non-transferable.
A member is considered active only while:
• their membership remains current;
• applicable membership fees have been paid; and
• their membership is in good standing.
Members whose fees are outstanding may have their membership suspended and may be ineligible to receive membership benefits, voting rights and other membership entitlements until outstanding amounts have been paid.
Members are responsible for ensuring their contact details, including their government email address, remain current and accurate. IPAA NSW is not responsible for non-receipt of notices resulting from outdated or incorrect member information.
Membership Term and Renewal Cycle
The IPAA NSW membership year runs from 1 July to 30 June.
Memberships operate on a common renewal cycle ending on 30 June each year.
New memberships purchased during a membership year will be charged on a pro-rata basis from the date of joining until the next 30 June renewal date.
Members who held an active membership prior to the introduction of the common renewal cycle and whose membership renews before 30 June 2027 will transition to the common renewal cycle at their next renewal in accordance with the renewal arrangements advised by IPAA NSW.
During the transition period, IPAA NSW may apply pro-rata fees, extensions, discounts or other transitional arrangements to facilitate alignment to the common renewal cycle.
Following transition, all memberships will renew annually on 1 July unless otherwise advised by IPAA NSW.
IPAA NSW may introduce, retire, consolidate or amend membership categories, benefits and eligibility requirements from time to time. Members will be advised of any material changes prior to renewal.
Membership Fees
Membership fees are determined by IPAA NSW and may be reviewed from time to time.
Membership fees, categories and benefits may be amended from time to time. Members will be advised of any material changes prior to renewal.
Members may choose to pay:
• annually (one upfront payment); or
• monthly via an approved Auto-Pay arrangement.
Membership fees are non-refundable except where required by law.
Monthly Payment Plans
Members electing to pay monthly must enrol in the IPAA NSW Auto-Pay facility.
Monthly instalments are a payment method only and do not create a month-to-month membership.
Monthly payments will continue until the end of the applicable membership term ending on 30 June.
By selecting a monthly payment option, members agree to pay the full membership fee applicable to their membership term
Monthly payment arrangements cannot be cancelled or amended during the current membership term, except where required by law or approved by IPAA NSW in exceptional circumstances.
Monthly payments will be processed on or around the first business day of each month.
Once enrolled, an Auto-Pay arrangement will remain in place for the duration of the current membership term and may only be cancelled or amended at the next renewal date, unless otherwise required by law.
Failed Payments and Membership Suspension
Members are responsible for ensuring their nominated payment method remains valid and able to process scheduled payments.
If a payment is declined or unsuccessful, IPAA NSW may make up to 3 additional attempts to process the payment and may contact the member to update payment details.
Where payment remains outstanding, IPAA NSW may suspend access to membership benefits, member pricing, member-only content, events, services and other membership entitlements until outstanding amounts are paid.
Members whose membership fees are overdue may be deemed inactive and may be ineligible to receive member benefits, discounts or voting rights during the period of non-payment
IPAA NSW reserves the right to cancel a membership where outstanding fees remain unpaid for more than 30 days.
Suspension or cancellation of membership does not release a member from any outstanding payment obligations associated with an agreed membership term or payment arrangement.
Renewals and Automatic Renewal
Memberships renew annually on 1 July each year.
Renewal notices will be issued on or around 1 June and will include the applicable membership fee and any changes to membership fees, categories, benefits or membership terms.
Members may elect to:
• renew manually; or
• opt into automatic renewal.
Members who opt into automatic renewal authorise IPAA NSW to process their annual membership renewal using their nominated payment method.
Members enrolled in automatic renewal will receive at least 14 days' notice before any renewal payment is processed.
Members may amend or cancel their automatic renewal election only after receiving their renewal notice and before the renewal payment is processed.
Cancellation of automatic renewal applies to future membership terms only and does not affect the current membership term or any outstanding payment obligations.
IPAA NSW may cancel membership where payment processing repeatedly fails or where membership fees remain unpaid.
Membership Changes
Upgrades: Upgraded membership benefits commence once any applicable upgrade fee has been paid.
Downgrades: Downgrades to a lower membership category are not available during an active membership term.
Requests to downgrade may be made at renewal and will take effect from the commencement of the next membership term.
Membership Categories and Eligibility
Members must meet the eligibility requirements applicable to their selected membership category.
IPAA NSW reserves the right to request evidence of eligibility at any time.
Where a member is enrolled in an incorrect category, IPAA NSW may:
• reclassify the membership to the appropriate category;
• adjust the applicable membership fee;
• require payment of any fee difference; and
• suspend access to membership benefits until any outstanding fee difference has been paid.
Member Conduct
In accordance with the Constitution of IPAA NSW, IPAA NSW members are expected to conduct themselves professionally and respectfully when participating in IPAA NSW activities, events, courses, online forums, communities and other member activities.
IPAA NSW reserves the right to suspend or terminate membership where a member:
• breaches these Terms and Conditions;
• breaches the Constitution of IPAA NSW;
• misuses membership benefits;
• engages in conduct that is unlawful, abusive, discriminatory, harassing or otherwise inappropriate; or
• acts in a manner that may bring IPAA NSW into disrepute.
Where reasonably practicable, IPAA NSW will notify the member of the reason for any suspension or termination.
Membership Cancellation
Members may elect not to renew their membership at the end of the current membership term.
Members who choose to resign their membership during a membership term are not entitled to a refund or credit for any unused portion of that term, except where required by law.
Membership fees already paid are non-refundable except where required by law.
Members who cancel their membership cease to be entitled to membership benefits, discounts and services from the expiry date of their membership.
Member Rate Policy
Member pricing for courses, events and other eligible activities is available only to active financial members of IPAA NSW.
To access member pricing, a member must:
• hold a current membership in an eligible membership category; and
• have no outstanding membership fees or overdue payment obligations.
Members whose memberships are suspended, expired or otherwise not in good standing are not eligible for member pricing until their membership has been reinstated and all outstanding amounts have been paid.
Where a member registers at a member rate and their membership subsequently lapses or is found to be ineligible prior to the course or event, IPAA NSW reserves the right to charge the difference between the member and non-member rate.
Eligibility for member pricing may vary between membership categories and activities. Any category-specific exclusions will be published at the time of registration.
Changes to the Website
You acknowledge and accept that we may from time to time alter, suspend or discontinue any aspect of the Website or the Content available through it, as we think fit and without notice to you.
Further, we may alter the Terms from time to time. If we do so, the updated version of the Terms will be effective as soon as it is uploaded on to the Website. We recommend that you revisit this page from time to time to ensure that you are aware of any changes that we have made to these Terms. By continuing to use the Website following any amendments to the Terms, you indicate your agreement to such amendments.
You accept that you will have no claim for breach of contract or otherwise in respect of any such alterations to the Website or these Terms.
Your Conduct
You warrant that in your use of the Website you shall:
a. use the Website only for lawful purposes, and in a manner which does not infringe the rights of, or restrict or inhibit the use of the Website by any third party; and
b. not engage in any conduct which is unlawful, or which may harass or cause distress or inconvenience to any person.

(b) the goods or services are not PDH Goods or Services, we limit our liability for a failure to comply with any Consumer Guarantee (other than where to do so would otherwise cause all or part of this clause to be void) to, at our option: (i) in the case of goods, repairing or replacing the goods or paying the cost of having the goods repaired or replaced; and (ii) in the case of services, re-supplying the services or paying the cost of having the services resupplied, and we do not exclude or limit the operation of the Consumer Guarantees under any other provision of these Terms or in any other manner and you agree it is fair and reasonable in all the circumstances for our liability to be so limited.

"Losses" means any liabilities, losses, damages, costs and expenses (including legal costs and expenses, regardless of whether incurred or awarded) arising in contract, tort (including negligence) or otherwise, and "Loss" has a corresponding meaning.
